TERMS AND CONDITIONS:

​ Scheduling/Cancellations: We strive to give a 24 hour notice due to inclement weather, but many times the decision to reschedule is made based on current conditions. In the event that the customer needs to reschedule, we ask that you give DnTree LLC 24-hour notice so that we may arrange our schedule as well.

Failure to Cancel: Failure to cancel an appointment that results in a “Wasted Trip” will result in a $375 fee. A “Wasted Trip” is defined as a scheduled trip that DnTree makes on company time that doesn’t result in any sort of revenue through no fault of our own and the potential customer failed to cancel/inform us with sufficient notice (estimates excluded). Examples of this are as follows (but not limited to): Showing up to an approved/scheduled Job to find the work already completed, showing up to a scheduled job and there are vehicles in the work area that cant be moved, showing up to a scheduled job and necessary access gates are locked (no one home to unlock.)

Ownership: The customer authorizes that all trees, plant material, and property upon which the work is to be performed, is owned by him/her, or permission for the work has been obtained from the property owner. DnTree LLC is not held accountable from all damage claims resulting from the customer’s failure to obtain such permission.

 

​Pedestrian/Vehicular Traffic: While working at your property, we will establish a work zone that will be designated by cones, signs, and/or caution tape. We ask that you do not enter that area unless permission is given by one of our staff. Branches can drop out of the tree suddenly and we do not want to put anyone in harm’s way.

 

​We ask that all children and pets remain inside for the duration of the project and that vehicles be moved so that we may maneuver our commercial vehicles. We also ask that anything in the landscape be moved if it is in close proximity to the work area.

 

​At no time is the customer allowed to assist in the tree and shrub care operations. We run highly specialized equipment by trained professionals.*

 

​Contractors: If DnTree LLC is working for you as a subcontractor, we will send an estimate to be approved (and signed by someone with the authority to do so) per Job. Estimates may change as the job changes (especially jobs with an hourly rate) pre-approval of these changes are not required. Invoices will be due at project completion. Contractors are also bound by all of DnTree LLC's Terms just as a regular customer would be.

 

​Driveways/Sidewalks/Yards: DnTree LLC will attempt to minimize any damage to driveways, landscape, and sidewalks. If there is an unknown void area under concrete, or thin spots, which thereby cause a structural failure under the load of our equipment, we are not responsible for this damage. Please make us aware beforehand of any concerns. If any damage is caused from falling debris as a result of our work, we will take full responsibility and correct the damage to the customers satisfaction. If DnTree LLC is subcontracting for another company, we will put our crane where ever you want us to and do everything in our power to minimize damage to concrete and yards but ultimately it is between you and your customer what your policy is to deal with those situations. DnTree LLC is not held responsible for damages done as a result of contracting services.

 

​Underground Utilities: DnTree LLC is not responsible for damages to underground sprinklers, drain lines, invisible fences, or underground cables unless the system(s) are adequately and accurately mapped by an authorizing party and a copy is presented before or at the time the work is performed.

 

​Hazards: There may be times that the estimating arborist was unaware of specific safety hazards (stinging insects, decay, compromised root zone). We have the right to stop all operations until the safety hazard has been mitigated.

 

​Additional Costs: Any additional work or equipment required to complete the work, caused by previously unknown foreign material in the trunk, the branches, underground, or any other condition not apparent in estimating the work specified, shall be paid for by the customer on a time and material basis.

 

​Electrical/Telephone/Cable Services: In the event that the scope of work would require overhead energized conductors to be removed from the house or structure, DnTree LLC will make the appropriate appointment prior to the work beginning. This may take several weeks, and appointments can be cancelled by the utility company at the last minute resulting in a reschedule of the work.

 

​Stump Grinding/Root Removal: Stump Removal will be performed by a representative of DnTree LLC, except for on the rare occasion that we subcontract the service out to a trusted 3rd party company. This service will need to have underground utilities marked in order to perform the job safely. No work (stump grinding) shall be performed until all utilities are marked. This may take up to two weeks after the tree has been removed. All inquiries about underground locating will be performed by DnTree LLC or their trusted 3rd party sub-contractor.

Snow Removal: DnTree LLC will perform snow removal operations for commercial customers and other contractors ONLY. DnTree LLC will not be held liable for any slips, falls, or accidents of any kind due to poor weather conditions. In the event of such an accident, the commercial customer (or contractor hiring DnTree LLC) agrees to indemnify DnTree LLC of any liability that may ensue. We do our best to keep areas clear during snowstorms but we CANNOT guarantee there will be no slip hazards present. In addition, DnTree LLC will not be responsible for pavement scraped and/or scratched during plowing operations.  

 

​Terms of Payment: Payment is required by check, cash, or credit card (through our invoicing system). Unless otherwise noted in this proposal, the customer agrees to pay account balance within 10 days upon completion of the work.

 

​Additionally, we charge a 3.5% processing fee for all credit card payments.

 

Failure to remit full payment within 10 days of the due date will result in a finance charge of 5% per month (compounding) up to 18.99% per year.

 

​Debris Removal: All debris from tree trimming and tree removal operations shall be cleaned up each day before the work crew leaves the site, unless otherwise discussed with the customer. All lawn areas shall be raked, streets and sidewalks cleared, and all brush, branches, and logs shall be removed from the site. If the scope of work requires multiple days, it will be discussed with the customer as to how the job site will be left after each day.

 

​Change Orders: Any additional work beyond the agreed scope of work or a change in the scope of work shall be documented and the customer will sign the change order. Work will not continue until confirma­tion and a signed change order is in place.

 

​Insurance/Indemnity: DnTree LLC is insured for liability resulting from injury to persons or property. The parties herein agree that in no instance may the customer seek damages in excess of DnTree LLC’s policy liability. Furthermore, once work is completed by DnTree LLC under this contract, owner agrees to indemnify and hold harmless DnTree LLC and its agents for any injury, loss or expense associated with work performed or in any way related to services performed with this contract. A copy of the insur­ance is available upon request.

 

​Governing Laws: The terms and conditions of this contract shall be interpreted and governed according to the laws of the State of Nebraska; venue and jurisdiction shall be limited exclusively to the District Court of Cass County, Nebraska.

 

 

​*Contractors and their employees do not count.
